Richard (Danny Warburton, Daniel Kirchner )
Born March 16, 1991, to Czechoslovakian
immigrant, Daniela Janikova in a Chicago-area
hospital. His father, Otakar Kirchner, was in
his native Czechoslovakia, visiting his ailing
grandmother, when the child was born. Four days
later, the child was in the home of adoptive
parents (the Warburtons). A confusion had
existed over Otakar Kirchner continuing a
previously known relationship with another
woman. Daniela called off the wedding, told
Otakar that their baby had died and gave the
infant up for adoption. Otakar was skeptical and
never gave up his search for his son. Skeptics
argue that Otakar abandoned the birth mother and
showed little interest in the infant.
Nevertheless, Otakar began the legal process (57
days after birth) to take custody of the child.
As a four-year-old boy, he was taken from his
adoptive parents in Schaumburg , Illinois on
April 30, 1995 and turned over to his biological
parents. The Illinois Supreme Court (prevailing
justices James D. Heiple, Michael Bilandic,
Charles Freeman, John Nickels, and Moses
Harrison II ) ruled that he be returned to his
biological parents because the rights of the
biological father were absolute. The case
brought forth a clash of 'humane' treatment of
an adopted child and his adoptive family and
their rights and the legal right of the
biological father. to 'possess' his child.
